Seminar on trade remedies
On October 11, 2024, within the framework of the Trade Remedies Forum: Strengthening endogenous capacity, promoting sustainable growth, the Trade Remedies Authority of Vietnam (Ministry of Industry and Trade) organized a Trade Remedies Workshop in Ho Chi Minh City. The workshop was attended by leaders of the Trade Remedies Department, representatives of ministries, departments, and branches at the central and local levels, and a large number of enterprises and associations.
At the workshop, representatives of the Trade Remedies Authority of Vietnam introduced a number of legal regulations on trade remedies that are expected to be supplemented and amended in 2024, provided guidance on how enterprises can submit and receive results of processing dossiers for trade remedies cases in the electronic environment, and introduced and guided enterprises in exploiting information and data of the early warning system.
Decree No. 10/2018/ND-CP consists of 7 chapters and 96 articles detailing a number of articles of the Law on Foreign Trade Management on trade remedies measures. After 7 years of implementation, the decree has established a solid legal corridor for investigating and applying trade remedies measures, playing a fundamental role in establishing and implementing legal documents on investigating and handling trade remedies measures. According to Mr. Phan Khanh An, Head of the Legal Department of the Trade Remedies Department, the decree replacing Decree No. 10/2018/ND-CP is currently being developed and revised in 2024, playing an extremely important role in trade remedies work. This decree will amend and supplement a number of articles of Decree No. 10/2018/ND-CP with 6 major groups of issues to be raised including: anti-dumping and anti-subsidy measures; self-remedies measures; review of trade remedies measures; anti-evasion of trade remedies; jurisdictional issues regarding exemption from trade remedies; compensation and retaliation claims. These changes will help create transparency and clarity for relevant parties during the investigation process, ensuring that the investigation is conducted fairly and in accordance with legal regulations.
In addition to legal amendments and supplements to improve the effectiveness of trade remedies, the Early Warning System is a powerful tool developed by the Trade Remedies Department with the aim of supporting businesses in proactively preventing risks and responding to trade remedies measures from importing countries; businesses can access and look up information and data from the early warning system to ensure publicity and transparency. According to Mr. Chu Thang Trung, Deputy Director of the Trade Remedies Department, information on the system is updated and provided quickly, businesses can look up export markets, export items, export turnover, export proportion, export growth rate, warning levels according to the system's assessment. From there, businesses can refer to the level of risk of investigation for their export items, have careful preparation, build appropriate strategies to minimize damage and maintain export markets. In addition to the early warning system, the system for submitting documents and looking up information on trade remedies cases (Trav Online) helps businesses proactively submit, monitor and receive results of processing documents on trade remedies cases in the electronic environment, while supporting businesses and individuals involved in the case to quickly and easily update and look up information to promptly respond to situations that may arise during the investigation process.
