Ministry of Industry and Trade of Viet Nam initiates the expiry review on the application of anti-dumping duties on certain plastic products made from propylene polymers originating from Malaysia, the Kingdom of Thailand and the People's Republic of China (Case number: ER01.AD07)

On 23rd July, 2024, the Ministry of Industry and Trade of Viet Nam issued Decision No. 1945⁄QD-BCT on the initiation of an expiry review on the application of anti-dumping duties on certain plastic products made from propylene polymers originating from Malaysia, the Kingdom of Thailand and the People's Republic of China (Case number: ER01.AD07).

The products under investigation can be classified under HS codes: HS 3920.20.10 and 3920.20.91.

The expiry review will assess the need, reasonability and socio-economic impacts if the measure is extended; to determine if the termination of the measure is likely to continue or recurrence of dumping and injury.

Next steps:

Pursuant to the Law on Foreign Trade Management, the Investigating Authority will send questionnaires to interested parties for collection of information to evaluate: (i) a likelihood that the imported products will be sold at dumped price if the anti-dumping measure is terminated; (ii) a likelihood that the domestic industry will suffer material injury or threat of material injury if the anti-dumping measure is terminated; and (iii) the causality between the likelihood of dumping and the likelihood of injury.

The Ministry of Industry and Trade will examine and verify the information provided by interested parties before making a final determination.

The Ministry of Industry and Trade encourages all enterprises, individuals who are importing, exporting, distributing, and using the products under investigation to register as an interested party and provide necessary information to the Ministry.

Entities can register as an interested party by filing the form provided in Annex 1 of Circular No. 37/2019/TT-BCT dated 29 November 2019 and submit it to the Investigating Authority through the Trade Remedies Case Online Filing System (TRAV ONLINE - https://online.trav.gov.vn) within sixty (60) working days from the issuance date of the decision. At the same time, the interested party may submit the form to the Investigating Authority by post or emails.

The deadline for registration as an interested party is 17 October 2024
