Canada reviews normal value of upholstered chairs from Vietnam

Regarding the case of the Canada Border Services Agency (CBSA) conducting normal value reviews within the framework of the anti-dumping (CBPG) and countervailing duty (CTC) investigations on upholstered chairs originating from Vietnam and China, based on discussions with CBSA, the Department of Trade Remedies (PVTM) would like to update some information as follows:

Currently, CBSA is conducting two (02) normal value reviews at the request of two (02) different groups of importers in Canada, including:

- Normal value review of a Vietnamese upholstered chair manufacturing and exporting company that has sales transactions with Wayfair LLC based in the United States, then exported to Canada (case code: UDS 2024 UP2); and

- The case of reviewing the normal value of upholstered chairs owned by Duc Thanh Company located at land plot No. 1250, map sheet No. 31, Tan Binh Quarter, Tan Hiep Ward, Tan Uyen City, Binh Duong Province (case code: UDS 2024 UP3).

The Trade Remedy Authority is currently coordinating with relevant ministries and branches to develop a questionnaire for the Government to provide information on relevant policies and legal regulations of Vietnam as requested by CBSA. It is expected that the questionnaire response will be completed and submitted to CBSA by 5:00 p.m. (ET) on April 29, 2024.

To effectively appeal the case, the Trade Remedies Authority requests that the relevant companies coordinate as follows:

- Regarding the UDS 2024 UP2 case, Vietnamese manufacturing and exporting companies that have sales transactions with Wayfair LLC need to continue to fully respond to the investigation questionnaire(s) issued by CBSA and submit them within the prescribed time limit. In the event that there are no sales transactions with Wayfair LLC, the companies need to proactively notify CBSA in writing and/or request CBSA to confirm that they do not need to participate in the case and notify the Trade Remedies Authority of the results at the contact address in this official dispatch.

- Regarding the UDS 2024 UP3 case, Duc Thanh Company needs to continue to discuss with CBSA to clarify the investigation questionnaire, related requirements and submit the response within the prescribed time limit. In case of a request for an extension to respond to the questionnaire, the Company needs to submit it 10 (ten) days in advance for CBSA to consider and resolve.

- Regularly visit the websites of CBSA and the Department of Trade Remedies to update relevant information and documents; keep in touch with the Department of Trade Remedies to receive timely support.
