The United States continues to extend the time to issue the final conclusion of the investigation to review the scope of products and prevent evasion of trade defense taxes on wooden cabinets imported from Vietnam

The Trade Remedies Authority of Vietnam has received information that the US Department of Commerce (DOC) continues to extend the time to issue the final conclusion of the investigation to review the scope of products and prevent evasion of trade defense taxes on wooden cabinets imported from Vietnam.

According to the DOC's announcement, the final conclusion of the investigation considering the product scope is expected to be issued on June 14, 2024. For the tax evasion investigation, the DOC has also continued to extend the time to issue the preliminary conclusion and the final conclusion of the case to June 28 and September 26, 2024.

In addition, the DOC has established a third-country case code under the automated system of the US Customs and Border Protection (CBP) for Vietnam: A-552-106-000 and C-552-107-000. The updated case code is to track the import procedures of related products into the United States.

At he same time, the DOC has issued draft guidance on the processes and procedures to verify the origin and product scope of imported wooden cabinets, including notes on suspension of liquidity and tax deposits; DOC and CBP certification mechanisms. For the draft guidance on these processes and procedures, interested parties have until April 19, 2024 to comment, and the deadline for submitting rebuttal comments is April 26, 2024.

The investigation into product scope and PVTM tax evasion was initiated by DOC in May and June 2022, respectively. In September 2023, DOC issued a notice of adjustment to the preliminary conclusion of March 2023, listing 3 cases of wooden cabinets imported from Vietnam with components manufactured in China as being subject to the original duty order against China.

Previously, from April 2020 to present, the United States has imposed anti-dumping (AD) and countervailing duties (CTC) on wooden cabinets originating from China with the anti-dumping tax rate ranging from 4.37% to 262.18%, the CTC tax rate ranging from 13.33% to 293.45%.
