The Trade Remedies Authority of Vietnam announces the receipt of dossiers for reviewing the application of trade defense measures on imported cane sugar products
On June 15, 2021, the Ministry of Industry and Trade issued Decision No. 1578/QD-BCT on the official application of anti-dumping tax (CBPG) and countervailing tax (CTC) on some cane sugar products originating from the Kingdom of Thailand (case code AD13-AS01).
On August 1, 2022, the Ministry of Industry and Trade issued Decision No. 1514/QD-BCT on the application of measures to prevent the evasion of trade defense measures on some cane sugar products imported from the Kingdom of Cambodia, the Republic of Indonesia, the Lao People's Democratic Republic, Malaysia and the Republic of the Union of Myanmar (case code AC02-AD13.AS01).
On August 3, 2023, the Ministry of Industry and Trade issued Decision No. 1989/QD-BCT on the results of the first review of the application of anti-dumping and countervailing measures on a number of cane sugar products originating from the Kingdom of Thailand (case code AR01.AD13-AS01).
Clause 1, Article 82 and Clause 1, Article 90 of the Law on Foreign Trade Management stipulate: After 01 year from the date of the decision to apply anti-dumping/countervailing measures, the Minister of Industry and Trade has the right to decide to review the application of anti-dumping/countervailing measures at the request of one or more parties involved in the investigation and on the basis of considering the evidence provided by the requesting party.
Clause 1, Article 58 of Decree No. 10/2018/ND-CP stipulates: “Within 60 days before the end of 01 year from the date of the decision to apply official anti-dumping and countervailing measures or the latest decision on the results of the review of anti-dumping and countervailing measures, the relevant parties as prescribed in Article 59 of this Decree may submit a dossier requesting a review, except in cases where the dossier submission period is less than 09 months from the deadline for the Minister of Industry and Trade to decide whether to conduct a final review of anti-dumping and countervailing measures or not”. Accordingly, the relevant parties as prescribed in Article 59 of Decree No. 10/2018/ND-CP have the right to submit a dossier requesting a review of the application of measures to prevent evasion of anti-dumping and countervailing measures and the application of anti-dumping and countervailing measures to imported cane sugar products. The deadline for the Trade Defense Department to receive the dossier is no later than August 3, 2024.
