The Ministry of Industry and Trade issued a Decision on investigation and application of anti-dumping measures against some galvanized steel products originating from the People's Republic of China and the Republic of Korea (Case number: AD19)
On June 14, 2024, the Ministry of Industry and Trade issued Decision No. 1535/QD-BCT on investigation and application of anti-dumping measures (CBPG) against some galvanized steel products originating from the People's Republic of China and the Republic of Korea classified under the HS codes 7210.41.11, 7210.41.12, 7210.41.19, 7210.49.11, 7210.49.14, 7210.49.15, 7210.49.16, 7210.49.17, 7210.49.18, 7210.49.19, 7210.50.00, 7210.61.11, 7210.61.12, 7210.61.19, 7210.69.11, 7210.69.12, 7210.69.19, 7210.90.10, 7210.90.90, 7212.30.11, 7212.30.12, 7212.30.13, 7212.30.14, 7212.30.19, 7212.30.90, 7212.50.13, 7212.50.14, 7212.50.19, 7212.50.23, 7212.50.24, 7212.50.29, 7212.50.93, 7212.50.94, 7212.50.99, 7212.60.11, 7212.60.12, 7212.60.19, 7212.60.91, 7212.60.99, 7225.92.90, 7226.99.11, 7226.99.91 (case code: AD19).
The decision to conduct an investigation was issued based on the results of the appraisal in accordance with the provisions of the PVTM Law on the Dossier requesting investigation to apply anti-dumping measures, which was fully and validly submitted on May 3, 2024 by enterprises representing the domestic manufacturing industry, including 05 companies: Hoa Sen Group Joint Stock Company; Nam Kim Steel Joint Stock Company; Ton Phuong Nam Company; Ton Dong A Joint Stock Company and China Steel & Nippon Steel Vietnam Joint Stock Company.
The domestic manufacturing industry has accused galvanized steel products from the People's Republic of China and the Republic of Korea of being dumped into the Vietnamese market and this dumping is causing significant damage to the domestic manufacturing industry.
Next steps:
According to legal regulations, after initiating the investigation, the Ministry of Industry and Trade will send the investigation questionnaire to relevant parties to collect information to analyze and evaluate the alleged contents including: (i) dumping behavior of exporting enterprises of the investigated countries; (ii) damage to the industry producing certain products in Vietnam; and (iii) the causal relationship between dumping behavior and damage to the industry producing certain domestic products.
If necessary, based on the results of the preliminary investigation, the Ministry of Industry and Trade may apply temporary anti-dumping measures to prevent dumping behavior from continuing to cause significant damage to the domestic manufacturing industry.
The Ministry of Industry and Trade will conduct an examination and verification of the information provided by relevant parties before completing the official investigation conclusion on the case. At the same time, the Ministry of Industry and Trade will also organize a public consultation for relevant parties to directly exchange, provide information, and express their views on the case before making a final conclusion on the case.
The Ministry of Industry and Trade recommends that all organizations and individuals who are exporting, importing, distributing, trading, and using investigated goods register as related parties and provide necessary information to the Ministry of Industry and Trade to ensure their rights and interests in accordance with the provisions of law.
Organizations and individuals can register as related parties in the case with the Investigation Agency according to the Related Party Registration Form issued in Appendix 1 attached to Circular No. 37/2019/TT-BCT dated November 29, 2019 of the Minister of Industry and Trade detailing a number of contents on trade defense measures and send it to the Investigation Agency at the address below in the following ways: (i) official dispatch or (ii) email.
The deadline for interested party registration is September 8, 2024.
