Ministry of Industry and Trade of Viet Nam issued the Decision No. 1407⁄QD-BCT on the result of new exporters review in the case of application of anti-circumvention measures on the imports of certain cane sugar products (case number: NR02.AC02.AD13-AS01)
On August 1st, 2022, the Ministry of Industry and Trade issued Decision No. 1514⁄QD-BCT on the application of anti-circumvention measures on the imports of certain cane sugar products from the Kingdom of Cambodia, the Republic of Indonesia, the Lao People's Democratic Republic, Malaysia and the Republic of the Union of Myanmar.
On June 10th, 2024, the Ministry of Industry and Trade issued Decision No. 1407/QD-BCT on the result of new exporters review in the case of application of anti-circumvention measures on the imports of certain cane sugar products (case number: NR02.AC02.AD13-AS01).
The Ministry of Industry and Trade conducted the new-shipper review upon the request from a new exporter - Kampong Speu Sugar Co., Ltd. (the Kingdom of Cambodia) which submitted the request in November 2023. During the investigation, the Ministry of Industry and Trade has complied with the relevant provisions of Law on Foreign Trade Management 2017 and Decree No. 10/2018/ND-CP dated 15 January 2018 of the Government detailing some articles of the Law on Foreign Trade Management on trade remedies measures.
Accordingly, the Investigating Authority has examined, verified the information provided by interested parties to identify that Kampong Speu Sugar Co., Ltd. is a new exporter which used sugarcanes harvested in the Kingdom of Cambodia as materials to produce/export products under investigation (PUIs) to Viet Nam.
The Investigating Authority also concluded that the use of sugarcanes harvested in the Kingdom of Cambodia to produce and export PUIs to Viet Nam by Kampong Speu Sugar Co., Ltd. does not circumvent anti-dumping and countervailing measures imposed upon some cane sugar products originating from Thailand pursuant to Decision No. 1578/QD-BCT dated 15 June 2021.
The Ministry of Industry and Trade will continue to coordinate with the General Department of Customs and other relevant agencies to monitor the supply and demand, prices, importing of cane sugar products as well as the impact of trade remedies measures to ensure a fair competitive environment, equality and harmony of interests among sugarcane farmers, sugar producers, sugar consumers and consumers./.
