Authority & Mission

         1. Position and function

1. The Trade Remedies Authority of Vietnam is an organization under the Ministry of Industry and Trade, which shall advise and assist the Minister of Industry and Trade in performing the State management and organization of law enforcement in the field of anti-dumping, anti-subsidy and safeguard measures; Organizing and managing the public service activities in the scope of the Authority according to the provisions of law and decentralization and authorization by the Minister.

3. The Trade Remedies Authority of Vietnam shall be a legal entity and have a seal and account according to the provisions of law, the operation funding allocated by the State budget and from other sources prescribed by the State.

 Abbreviation in English: TRAV

The Headquarter of TRAV is in Hanoi.

2. Tasks and Competence

1. To elaborate and submit to the Minister of Industry and Trade for promulgation, or to propose the Minister of Industry and Trade submiting to the competent agencies for approval and promulgation of legal documents, schemes, strategies, mechanisms and policies on anti-dumping, anti-subsidy and safeguard measures.

2. To organize the implementation of legal documents, schemes, strategies, mechanisms and policies on anti-dumping, anti-subsidy and safeguard measures after they are approved and promulgated by competent agencies.

3. To issue professional guidelines of activities of anti-dumping, anti-subsidy and safeguard measures, special documents and internal documents in accordance with its competence and the provisions of law.

4. To perform the state management of anti-dumping, anti-dumping and safeguard measures against goods imported into Vietnam.

a) To chair, or coordinate with concerned agencies in implementation of law provisions on anti-dumping, anti-subsidy and safeguard measures for goods imported into Vietnam;

b) To handle dossiers and organize the investigation of the import from foreign goods into Vietnam; To propose the application of anti-dumping, anti-subsidy and safeguard measures according to law provisions;

c) To report investigation result of anti-dumping, anti-subsidy and safeguard cases to the Minister of Industry and Trade for decision on the application or non-application of anti-dumping, anti-subsidy and safeguard measures against imported goods into Vietnam;

d) To propose the Minister of Industry and Trade to issue decisions on the application of anti-dumping, anti-subsidy and temporary safeguard measures according to the provisions of law;

đ) To propose the Minister of Industry and Trade to issue decisions on the application of anti-dumping, anti-subsidy and official safeguard measures according to the provisions of law;

e) To assume the prime responsibility, and coordinate with concerned agencies in guiding the implementation, monitoring and controlling the application of decisions on anti-dumping, anti-dumping and safeguard measures.

5. State management of anti-dumping, anti-subsidy and safeguard measures regarding Vietnamese exports

a) Early warning of anti-dumping cases against Vietnamese exports;

b) To chair or coordinate with concerned State agencies, enterprises and trade associations in handling anti-dumping, anti-subsidy and safeguard cases of foreign countries against Vietnamese exports;

c) To perform related  work to settle disputes of trade remedies cases and other matters related to trade remedies at the WTO, trade agreements and other international organizations;

d) To focalize, coordinate with relevant ministries and sectors in dealing with the market economy status with concerned countries and territories;

đ) To chair and/ or participate, discuss and negotiate trade remedies matters in international trade treaties, Joint Committees between Vietnam and international partners as well as other international forums as assigned by Head of Ministry of Industry and Trade.

6. To contribute comments on the content of work related to trade remedies proposed by other agencies inside and outside the Authority.

7. To participate in international cooperation in anti-dumping, anti-subsidy and safeguard.

8. To request concerned organizations and individuals provide necessary information and documents for the performance of the assigned tasks; To use domestic and foreign consultants in case of necessity according to the requirements of work according to the provisions of law.

9. To propagandize, educate and disseminate laws and policies related to anti-dumping, anti-subsidy and safeguard regarding goods imported into Vietnam and export goods from Vietnam.

10. To organize training and fostering professional qualifications to organizations and individuals involved in anti-dumping, anti-subsidy and safeguard in respect of goods imported into Vietnam and for export goods from Vietnam.

11. To coordinate with the Department of Organization and Personnel in performing the task of State management on professional associations/ associations in the fields according to the provisions of law.

12. To organize, build databases, manage and provide information to state agencies, organizations and individuals as requested in accordance with the law on the application of anti-dumping, anti-subsidy and safeguard measures against goods imported into Vietnam and for export goods of Vietnam.

13. To organize specialized inspection and supervision the application of law provisions related to anti-dumping, anti-subsidy and safeguard measures against imports into Vietnam; To settle complaints and denunciations according to the provisions of law and decentralization management of the Ministry of Industry and Trade.

14. To develop and implement the administrative reform program of the Authority according to the objectives and contents of administrative reform program of the Ministry of Industry and Trade.

15.To manage the organization, payrolls, officials and employees to implement the wage regime and policies on preferential treatment for emulation, commendation and disciplining of professional skills for officials, civil servants of the Authority in accordance with the law and decentralization management of the Ministry of Industry and Commerce.

16. To manage the assigned finance and assets as well as to organize the implementation of the allocated budget according to the provisions of law.

17. To perform other duties as assigned by the Minister.
