India initiates anti-dumping investigation on nylon filament yarn originating or imported from China and Vietnam

On December 26, 2024, the Directorate General of Trade Remedies (DGTR) of India initiated an anti-dumping investigation (ADI) on nylon filament yarn originating or exported from China and Vietnam. Specifically as follows:

- Products under investigation: nylon filament yarn with HS codes: 54021910; 54021990; 54023100; 54023200; 54024500; 54025100; 54026100 and 54021920 (HS codes are for reference only, detailed product descriptions are available in the notice of initiation).

- Plaintiffs: Century Enka Private Limited, Gujarat Polyfilms Private Limited, Oriilon India Private Limited.

- Investigation period: (i) anti-dumping investigation period (POI): 01/04/2023 to 30/06/2024 (15 months); (ii) injury investigation period: 01/04/2020-31/03/2021, 01/04/2021-31/03/2022, 01/04/2022-31/03/2023 and POI.

- Product Classification Number (PCN): Plaintiff has not proposed PCNs as a basis for price comparison. DGTR requests the interested parties to submit their comments on the product scope and PCN code within 15 days from the date of initiation, i.e. no later than January 09, 2025.

- Relevant information should be sent to DGTR via email: adg16-dgtr@gov.in; adv11-dgtr@gov.in; jd11-dgtr@gov.in; dd19-dgtr@gov.in within 30 days from the date of public petition being forwarded to the enterprise or diplomatic mission of the exporting country. In case of not receiving the information within the prescribed time and in the prescribed manner, DGTR will use the available information to conclude the case.

- Detailed information (on investigated goods, similar goods, domestic production industry, investigated country, investigation phase, dumping allegations, allegations of damage and causal relationship, regulations on information submission, deadlines for providing information, information confidentiality procedures, regulations on public information provision, regulations on non-cooperation, etc.) can be found in the attached Notice of Initiation of Investigation.

In order to promptly respond to the case, the Department of Trade Remedies recommends that the Association and Vietnamese enterprises producing and exporting investigated goods do the following:

- Carefully study the Notice of Initiation of Investigation, proactively request DGTR to provide all necessary information and documents during this period (including Request File - public version, CBPG Investigation Questionnaire);

- Arrange necessary resources to handle the case (consider hiring a consulting lawyer to support if necessary);

- Proactively provide comments on product scope, PCN code and submit to DGTR in accordance with the prescribed form and time to ensure the interests of enterprises;

- Respond to DGTR's CBPG investigation questionnaires on time and in compliance with instructions, ensuring the implementation of obligations on information confidentiality and public disclosure of information to other relevant parties;

- Fully and comprehensively cooperate with DGTR throughout the entire process of the case (including responding to investigation questionnaires, on-site inspections, attending hearings, etc.);

- Contact and provide information to the PVTM Department to receive timely support.
