Ministry of Industry and Trade Issues a Decision to Initiate a Sunset Review of the Anti-Dumping Measures on Certain H-Section Steel Products Originating in Malaysia (Case No. ER01.AD12)
On May 28, 2025, the Trade Remedies Authority of Vietnam (TRAV) issued a notice regarding the receipt of requests for a sunset review of the anti-dumping (AD) measures applicable to certain H-section steel products originating in Malaysia. Following the expiry of the deadline specified in the notice, TRAV did not receive any request for a sunset review of the above-mentioned case.
Pursuant to Clause 2, Article 82 of the Law on Foreign Trade Management, on July 8, 2025, the Ministry of Industry and Trade issued Decision No. 1978/QD-BCT initiating a sunset review of the anti-dumping measures on certain H-section steel products originating in Malaysia (Case No. ER01.AD12).
Pursuant to Point b, Clause 2, Article 82 of the Law on Foreign Trade Management and Clause 4, Article 52 of Government Decree No. 86/2025/ND-CP, which provides detailed regulations on certain provisions of the Law on Foreign Trade Management concerning trade remedies, the investigating authority will determine:
- The volume and quantity of subject merchandise imported into Vietnam since the imposition of the anti-dumping and countervailing measures; and
- The necessity, reasonableness, and effectiveness of the measures, as well as their socio-economic impact.
Next Steps
The sunset review under Case No. ER01.AD12 will be conducted in accordance with the Law on Foreign Trade Management and Decree No. 86/2025/ND-CP, which provides detailed regulations on certain provisions of the Law on Foreign Trade Management concerning trade remedies.
Under the applicable regulations, following the initiation of the review, the investigating authority will issue questionnaires to interested parties to collect relevant information. TRAV will conduct verification and examination of the information provided by interested parties before completing and issuing the final determination in the case.
Recommendation from the Ministry of Industry and Trade
The Ministry of Industry and Trade recommends that all organizations and individuals involved in the import, export, production, distribution, trading, or use of the subject merchandise register as interested parties and provide the necessary information to the Ministry of Industry and Trade in order to protect their legitimate rights and interests in accordance with the law.
Organizations and individuals wishing to register as interested parties should use the Interested Party Registration Form provided in Appendix I to Circular No. 26/2025/TT-BCT dated May 15, 2025, and submit it to the investigating authority through the Trade Remedies Online Filing System (TRAV ONLINE – https://online.trav.gov.vn) within sixty (60) working days from the effective date of the decision initiating the review.
The Interested Party Registration Form may also be submitted to the investigating authority by postal mail or email.
